How to appeal if you feel unhappy about a planning decision.

If you feel unhappy about a planning decision, because it has been refused or because conditions have been imposed which you feel are unacceptable, you can appeal to the First Secretary of State at The Planning Inspectorate, 3/07 Kite Wing, Temple Quay House, 2 The Square, Temple Quay, Bristol BS1 6PN. You can choose one of three methods of appeal:

  • Written Representations - these types of appeals are dealt with by an exchange of written statements and a site visit by an Inspector from the Planning Inspectorate.
  • Hearing - these types of appeals comprise an informal discussion of the merits of the case between the appellant and the Council and are chaired by an Inspector from the Planning Inspectorate.
  • Public Inquiry - these types of appeals are often used for major applications and take the form of a formal court case.

A period of six months is given for you to appeal against the Council's planning decisions, except for Advertisement applications whereby the time given for you to appeal is 8 weeks. If South Bedfordshire District Council has not determined your application after eight weeks (or thirteen weeks in the case of major applications) you also have a right of appeal.

Only applicants have the right to appeal against the Council's decision and the Planning Inspectorates appeal decision is final unless defective on a point of law. In such a case, the appellant can appeal to the High Court. Third parties, including objectors, have no rights of appeal against the Council's decision.
